I’m ineligible to have a gun, but I’m charged with possessing one – how much time am I facing?
Simply being charged with possessing a firearm while ineligible does not ensure prison time. There may be many possible factual and legal challenges to the State’s charge that could potentially result in suppression of evidence or a dismissal. However, with a guilty plea or verdict, certainly jail or prison time is a possibility with these types of cases.
