Q&A Series: Domestic Charges

Can the alleged victim in a domestic case drop a criminal charge?

In every criminal case, it is the State that brings criminal charges, on behalf of the public, against a defendant accused of committing a crime. In a case involving allegations of domestic assault, the alleged victim does not have the power to drop or dismiss a criminal charge. However, the prosecutor is required to obtain input from an alleged victim of domestic assault regarding how the criminal case resolves.
